Can I Get Out Of My Lease?

Ok.. I have a question... can I get out of my Lease?

long story short, I'm not happy with the piss poor tint job on the car, and it's something that's on my lease agreement.

After a few attempts at fixing it, the dealership is telling me they won't cover the cost of a proper re-tint.

The tint is not acceptable IMO.. just a lazy job.. bubbles in the back window, poorly installed felt liners in the sides, poorly redone driver's window, and passenger side that wasn't redone when felt liners were installed (due to scratching).

So if the dealership is unable to fix it, and I have to eat the cost, could I just turn around and say, "keep the car, I don't want it, since you can't deliver on the lease agreement"?

I've gone so far for this car, and believe I've been more than reasonable waiting to get the car I originally ordered, but I've not yet received it in my opinion..

so far, the dealership has
- reordered the entire car once (they ordered the wrong interior colour)
- retinted windows 3 times (scratching, bubbles, missed strips, etc)
- ate the cost of wheel sensors, straps and installation for the 18" wheels I ordered through them
- ate the cost of steering rack spacers and install to correct wheel fitment issues.

but 7 months into posession of a car I ordered 11 months ago, and I still don't have the shiny new car I wanted...

any suggestions? I'm at the end of my rope here, and would seriously consider just handing them the car back and going elsewhere just out of principle.

If the car is more trouble than it's worth, you have the right to tell them.

Dude, I'm just sick to my stomach for you. This is awful. (Try to love the car Steve, if not, it's going to be a LONG 4 years)

Remember that customer service number that people post here like once at month??..........yeah thats all you can do, is call it.

I was in a lease too and once you sign that paper its Ford Credit Canada's car not the dealerships..........call your lawer or call the Ford line.
I drive a 2010 Golf that growls at people when it goes over 3000rpm.

If your persistent then just get in their face about this, call the #'s take it to the top. You haven't got what you wanted yet so a little bit of complaining can only make it better.

Just remember the squeaky wheel gets the oil....

It worked for me.

Mind you it took 2 years for them to come through.

oh, I'm squeaking... it's just that even if they just refund me, I still have to pay to get the tint removed and then redone... which ain't gonna be cheap..

and lo-and-behold, they're offering to refund my money..

You might be able to end your lease early if you go to another dealer for another lease.

I wish there was something I could do. :(

I can't see what the big problem is, Mustangs get tinted all the time. I've not heard of someone having that many problems.

Since they're offering to refund to you the cost of the tint, this is a little late in the game, but it may prove helpful to someone else here.

Talking from a legal/contract perspective for a second, here are my thoughts:

1) You ordered a car done to certain specifications. To date you maintain that they have not delivered, they maintain that they have.

2) Your first step should be a letter of complaint to the dealership, outlining what was promised by them versus what was delivered and what resolution that you would like to see. Send it registered mail.

3) If no response or they tell you to go pound sand, I would suggest going above their heads, as others have, through the customer complaints arm of FoMoCo of Canada

4) If nothing gets resolved there, then you'd be looking at going the legal route. Where you go next is depending on the amount in dispute and what it is that you are seeking. Because you would be seeking the termination of the lease contract and the value of the total lease exceeds $10K, you would be looking at a claim at Superior Court under the Simplified Procedures.

The above is the quick & dirty answer and doesn't necessarily apply to all situations equally, so take this advice with that caution.

Their QA manager says it's normal... I don't recall it buzzing like that when I picked it up, and it's quite annoying...

Snag a lawyer, show him the original lease agreements with the stipulations in it and the documentation that supports how things have NOT gone as planned. Find out what your best road is.

There's no easy way to get out of a lease without jeopardizing your credit rating - and after all you do need a vehicle to drive and your dissatisfaction with the vehicle doesn't impact that. So here's my recommendation and if you need any help with any aspect of it, let me know.

1) Exhaust all possibilities with the dealership: if you haven't met with the Dealer Principal yet, then you have at least one more option with them and I can give you some insight into the hot buttons that would motivate a DP to want to avoid having you as a problem customer.

2) If that doesn't resolve the issue then involve Ford and Ford Credit (assuming its an RCL lease) - but rather than phone I'd do it in writing (making sure to notify them that going back to the dealership is absolutley not an option) and I can give you the names of the people who should be cc'd on the letter. The phone call you get back will be from the CRC (Customer Relationship Centre) or a little known group called the "Executive Office" response who deals with particularly difficult or sensitive matters - that's who I dealt with on my heater duct concern.

3) Failing satisfaction there, the next step is to initiate a CAMVAP claim.

At any point in this process, if it were me I'd simply pay to have a proper tint job done, and if you really wanted to get some attention, also remove a small portion from your lease payment (do it by cheque with the proper notation on the cheque) and claw back the amount you paid the dealer for the tint, plus the additional amount if you have to pay more for the aftermarket job.

interesting..I'm not sure how you go about removing a small portion from the lease payment as I'm auto-debit... but the dealership is refunding the $299 + tax (cheque in the mail).

They won't pay to have the tint removed tho... guess it's going to cost me a few extra to get it done properly.

I did my best to give the dealership every benefit of the doubt, and they were kind enough to swallow $900 in extra costs on their own so far, but man, the one thing to learn from this is just buy your car off the lot. The moment you try anything remotely different, you're gonna suffer for it.

Well there is always one option for you steve and I would suggest a visit to this site http://www.leasebusters.ca they help people get out of their car / truck / SUV's lease all the time, though you might have to make an incentive for someone to take over your lease from you.
I was the only member on this board with a Yellow Focus Sedan, and a 2002+ Euro Facelift on a sedan.

Three things:

1) don't use auto-debit; reduces your flexibility - if you need to automate do it through your own online banking. If you're intent on making some noise about this, you can cancel your auto debit.

2)Although you might be happy with the $1200, you should consider how much of this added cost was their own fault and how much was actual largesse.

3)IIWY, I'd wait until their cheque cleared and then send them an invoice for the removal of "their" tint - if they can't even pick the right sub-supplier to do the job two or three times (and the subsequent inconvenience to you) then they don't deserve your charity and they should pay to have it removed. Only under those conditions would I think it acceptable that you pay for the new tint job. To me it's no different than if they fawked up something else on your car while in their shop ... it should be up to them to make it right.

If you have a good salesperson they will know who to talk to in the dealer to get things done , if you purchased it with tint then your suppose to have tint. go see the business manager.

That's exactly why we did what we did. It was either the black ZX5 with the moonroof that I didn't fit, or the red ZX5 that I did fit. There was a red ZX5 with GFX, but I just can't love it all the time.

Keep your chin up, we did it. I went in there and demanded they take the car back. You have a few months more into then us. But like i said, i had to go in there several times and tell THEM how it was gunna be. Credit rating be dammed. But be carefull this might not work everytime.
